People reports that Margarita Palestino alleges that Charlie committed assault, battery, sexual battery and intentional infliction of emotional distress on September 25 when he went to the dentist to have an abscess treated. She filed the papers yesterday in the Superior Court of the State of California. Margarita claims in the paperwork that she was assisting the dentists when Charlie pulled off his nitrous oxide mask and shouted, “I’m going to f**king kill you!” at everyone in the room.
The dentist reportedly ordered Margarita to put the mask back on Charlie, which is when the actor grabbed her “left breast area” and then “grabbed her bra strap, and forcefully pulled it down in an attempt to open or remove her bra,” according to the court papers. The dental tech fled the room.
She claimed Charlie threatened the dentist with a knife while she was out of the room. According to TMZ, the dentist denied those charges. When Margarita returned to the room, she said the room was in “disarray” with spit covering the walls. Charlie reportedly refused to stay seated and instead “violently bolted out of the dental chair, and forcefully punched [Palestino's] chest.”
Margarita said Charlie’s bodyguard gave her $500 “for your troubles,” but the dentist made her clean the spit off the walls. She claimed the dentist also told her Charlie was “high on a combination of crack cocaine, Theradol and alcohol.” This wouldn’t exactly be shocking.
She wants compensation for her “physical injury, pain and suffering, and mental anguish.” She also wants a jury trial. Something tells me Charlie’s attorneys are going to end up settling this case. Who knows what Charlie would do on a witness stand?
For his part, Charlie is denying everything: he admits he DID act up in the dentist’s office but claims it was a bad reaction to the nitrus oxide, not because he was high on anything. His rep also told TMZ Charlie was taking some meds for a shoulder injury. The rep claims Charlie’s arm did “flail” and knock over a tray of dental instruments, but that’s it. Charlie’s attorney, Marty Singer, said:
The story is being made up by this woman [the dental technician] who was fired on Friday for violating HIPAA by telling her son Charlie was in the office. It got back to Charlie and the dentist fired her.”
When police interviewed the dentist, he claimed the dental tech was lying (at this point, the claim was only that Charlie had threatened the dentist with a knife). Despite these discrepancies, something tells me this dental tech is still going to see a nice payday. Charlie’s reputation would definitely work against him in a jury trial, and why would he want to go through with that? What do you think?
